Terms and Conditions for Registration to Online Pass Issuance System

1.ACCEPTANCE OF TERMS

New Mangalore Port Authority (NMPA) provides the Service (defined below) to you, subject to the following terms of service which may be updated by us from time to time without notice to you. You can review the most current version of the terms of service at any time at http://newmangaloreport.gov.in

2.DESCRIPTION OF SERVICE

NMPA currently provides users with access to the collection of online resources through the network of properties rights to which are granted to NMPA. The Service at NMPA's discretion, may be accessed or made available through World Wide Web, mobile or communications service (such as SMS - Short Message Service). You also understand that agree that the service may include certain communications from NMPT such service communications, administrative messages and that these communications are considered as part of NMPA Users membership and you will not be opt out of receiving them. You understand and agree that the service is provided “AS-IS” and that NMPA assumes no responsibility for the timeliness, deletion, un-delivery or failure to store any user communications or personalization settings.

In order to use the service, you must obtain access to the channels, either directly or through devices that access web-based content, and pay any services fees associated with such access to the service in accordance with the applicable payment terms. Such fees and payment terms may be changed to time to time, and such changes will be notified to you, either by email or by notices or links to notices on the service or by other appropriate means. You acknowledge that we are not responsible or liable in any way for your access to the service.

In addition, online passes issued to you through the web access, the additional conditions are strictly adhere to, which is as follows:

(a) The pass is not transferable.
(b) The pass holder is not permitted to visit any other areas except specified in the pass.
(c) The pass holder should not carry any objectionable materials like explosives, fire arms, sharp edged knives etc.
(d) The pass holders should not carry any inflammable materials like match box, lighters, petroleum products, gases etc unless specifically permitted.
(e) NMPA Management shall not br responsible for any damage, injury etc. sustained by the pass holder during the visit to the Port. The visit shall be exclusively at his / her own risk.
(f) NMPA Management shall reserve the right to revoke the pass without assigning any reason.
(g) In case of loss of the pass, pass holder should do a police compliant to the nearest Police Station with the intimation to the Issuing Authority.
(h) Tampering of the content of the pass is punishable as per law and pass will become invalid.

3.YOUR REGISTRATION OBLIGATIONS

In consideration of your use of the service, you agree to:
1. Provide true, accurate, current and complete information about yourself as prompted by the Service's registration form and
2. Maintain and promptly update the registration date to keep it true, accurate and complete. If you provide ant information that is untrue, not current or incomplete, or NMPA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, NMPA has the right to suspend or terminate your account and refuse any and all current or future use of the service without any liability to you.

4.MEMBER ACCOUNT, PASSWORD AND SECURITY

You will receive account designation and a password with confirmation after completing the Services's registration process. You are responsible for maintaining the confidentiality,of the account and password and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify NMPA of any unauthorized use of your account or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. NMPA will not be liable for any loss or damage arising your failure to comply with this section.

5.LINKS

The Service may provide or third parties may provide links to other World Wide Web or other online electronic sites or resources. You acknowledge that NMPA has no control over such sites and resources, except on Payment gateway site, and agree that NMPA is not responsible for the availability of such external sites or resources.

6.DISCLAIMER OF WARRANTIES

Your accessing or use of the service at your sole risk. The service is provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

7.UNDERTAKING

You are liable for the acceptance of the Undertaking which is as under:

In accordance with sub-section (3) of section 42 of Major Port Trust Act 1963, we hereby declare that the levy of charges for services shall not be exceeding the rates prescribed by TAMP (Tariff Authority of Major Ports).

We further undertake that in case of any violation, the registration will be liable for cancellation and we will be held responsible for the cost and consequences.

We hereby declare that information furnished above is true. Further, we undertake that we are fully responsible for ensuring good conduct of our employees / companions inside the port premises. We agree that in the event of misuse of Dock Entry Permit in whatsoever manner NMPA administration is liable to take action as deemed fit including cancellation of our registration summarily.

We also confirm that we shall continue to perform our bona-fide existing business in the port and possess all relevant documents related to our firm/company.

8.GENERAL INFORMATION

Entire Agreement. The Term of Service (TOS)constitute the entire agreement between you and NMPA and govern your use of the service, superseding any prior understandings and agreements between you and us and any previous statements or representations from either party to the other party. You also may be subject to additional terms and conditions that may apply when you use affiliate services.

Governing Law and Jurisdiction. The TOS and the relationship between you and NMPA shall be governed by the laws of the Republic of India without regard to its conflict of law provisions. You and NMPA agree to submit to the personal and exclusive jurisdiction of the courts located at Mangalore.
